Recently, a panel of Brazil’s federal supreme court justices voted unanimously to uphold orders suspending the use of Elon Musk’s social network X nationwide. This decision has sent shockwaves through the tech industry and sparked a debate on freedom of speech and judicial overreach. One justice, Luiz Fux, voted to uphold the decision but expressed concerns regarding the court’s ability to fine individuals or businesses that attempt to bypass the suspension using methods like VPNs.
The court’s top justice, Alexandre de Moraes, issued the controversial suspension orders after Musk and X failed to comply with requests to take down accounts or posts that violated Brazil’s laws on political misinformation and hate speech. De Moraes warned Musk and X to appoint a legal representative in Brazil within 24 hours or face the penalty of suspension of activities. The court also took the drastic step of freezing the financial assets of another Musk-led business, Starlink, to ensure compliance with the fines imposed.
Despite the court orders, X continued to defy the Brazilian authorities, leading to the app and website becoming mostly inaccessible to users in the country. Brazil’s telecoms regulator instructed internet service providers to block access to X until it complies with the court orders. Starlink, however, has indicated that it does not intend to comply with the orders, putting its licenses to operate in Brazil at risk of being revoked.
Elon Musk and his companies have vehemently opposed the court’s actions, calling them “illegal” and lacking due process. Musk has escalated his rhetoric, even calling de Moraes a “criminal” and threatening reciprocal seizures of government assets. Despite being known as a free speech proponent, Musk’s track record on content removal has been inconsistent, with X removing critical content in countries like Turkey and India.
The decision to block X has divided users and politicians in Brazil, with many questioning the legitimacy of the ban. The absence of X has left many Brazilians struggling to navigate other social media platforms. Some users are migrating to alternative networks like Bluesky, showing a shift in the social media landscape in the country.
